OFFICIAL RULES

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.

Danny Duncan Giveaway (the “Sweepstakes”) is intended for legal residents of the fifty United States and the District of Columbia, and will be governed by U.S. law. Do not enter if you are not located in the United States at the time of entry. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor, which are final and binding in all matters related to the Sweepstakes. Winning the Grand Prize is contingent upon satisfying all requirements set forth herein.

SPONSOR: Danny Duncan, PO Box 1456, Englewood, FL 34295 (the “Sponsor”).

ELIGIBILITY: Open to legal residents of the fifty United States and the District of Columbia who are at least thirteen years old at the time of entry (“Entrant”). Employees, officers, and directors of Sponsor, their immediate family members, and members of their household, and any other persons or entities associated with this Sweepstakes are not eligible to enter or win. Void outside the United States and where prohibited or restricted by law.

If an Entrant is under the age of majority in their state of residence at the time of entry, the prize will be awarded in the name of the Entrant’s parent or legal guardian, who must agree in writing to be bound by these Official Rules and will be responsible for any tax obligations. If the parent or legal guardian declines to accept the prize and follow these requirements, the prize will be forfeited.

SWEEPSTAKES PERIOD: The Sweepstakes begins at 12:00:01 a.m. Pacific Time on October 1, 2025 and ends at 11:59:59 p.m. Pacific Time on October 31, 2025 (the “Sweepstakes Period”). Sponsor’s computer is the official timekeeping device for this Sweepstakes.

HOW TO ENTER:

  1. Online Store Entry: During the Sweepstakes Period, eligible entrants may visit https://dannyduncan69.com (the “Website”) and follow the on-site instructions to enter. Any entry limits, if applicable, will be stated on the Website.

Fraud Notice: Any fraudulent activity in connection with this promotion is strictly prohibited. It is fraudulent to purchase items to obtain entries with the intent to return those items after the promotion. If Sponsor identifies or suspects that you are engaged in this or any other fraudulent activity, you will be disqualified and banned from any further sweepstakes or promotions offered by Sponsor.

  1. Mail-In Entry (No Purchase Necessary): To receive ten entries without making a purchase, hand-print on a 3 x 5 inch card your full name, complete mailing address, phone number, and email address, and mail it in a #10 envelope with proper postage to: Danny Duncan Giveaway Sweepstakes, PO Box 1456, Englewood, FL 34295. Limit one mail-in request per envelope. Each valid mail-in request will receive ten entries. Mail-in entries must be postmarked by October 31, 2025 and received by November 7, 2025. Bulk shipments and mechanically reproduced entries will not be accepted. Mail-in entry card and envelope must be hand-printed by the Entrant only. Entrants are not permitted to use any third-party organization to assist with the entry process.

All required information must be provided for an entry to be eligible. Incomplete, illegible, late, misdirected, or postage-due entries will be disqualified. All entries become the property of Sponsor and will not be acknowledged or returned. By participating, you consent for Sponsor to obtain, use, and transfer your name, address, and other information for the purpose of administering this Sweepstakes and as otherwise set forth below.

GENERAL CONDITIONS: If for any reason the Sweepstakes is not capable of running as planned, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process and to cancel, terminate, modify, or suspend the Sweepstakes in whole or in part. In such event, Sponsor may award the prize in a manner that is fair and equitable using all eligible, non-suspect entries received up to the time of the action or as otherwise deemed appropriate. Any attempt to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws. Sponsor reserves the right to seek damages and other remedies to the fullest extent permitted by law. In the event of a dispute as to the identity of a winner based on an email address, the winner will be deemed to be the authorized account holder of the email address used to enter.

RELEASE AND LIMITATIONS OF LIABILITY: By participating, entrants agree to release and hold harmless Sponsor and their respective parents, subsidiaries, affiliates, distributors, sales representatives, advertising and promotional agencies, and each of their respective officers, directors, employees, and agents (collectively, the “Released Parties”) from any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize, including, but not limited to, technical errors, unauthorized human intervention, printing errors, errors in the administration of the Sweepstakes, or injury or damage to persons or property. Entrant agrees that the Released Parties’ liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event will the Released Parties be liable for attorneys’ fees, punitive, consequential, direct, or indirect damages.

DRAWING AND NOTIFICATION: One potential Grand Prize winner will be selected in a random drawing conducted by Sponsor or its designee on or about November 5, 2025 from among all eligible entries received. The potential winner will be notified by email and or phone using the contact information provided at entry.

PRIZE: One Grand Prize will be awarded. Upon verification, the Grand Prize winner will receive a “Honda Fit and 6' Mini Jet Boat” from Danny Duncan. Prize will be fulfilled within ninety days after winner verification. No substitution or transfer of the prize is permitted, except by Sponsor, who may substitute a prize of equal or greater value at its sole discretion. All expenses not expressly stated as included are the responsibility of the winner. Odds of winning depend on the number of eligible entries received.

PRIZE CONDITIONS: The potential winner may be required to complete, sign, and return an Affidavit of Eligibility, Liability Release, and where lawful, a Publicity Release within seven days of notification. The Affidavit may require the winner’s Social Security Number solely for tax reporting purposes. The winner is responsible for all federal, state, and local taxes associated with acceptance and use of the prize, and will receive an IRS Form 1099 reporting the value of the prize if required by law. If a prize or prize notification is returned as undeliverable, if the potential winner cannot be contacted within three business days, or fails to return required documents on time, or is not in compliance with these Official Rules, the prize may be forfeited and an alternate winner selected.

PUBLICITY: Where permitted by law, acceptance of the prize constitutes permission for Sponsor and its designees to use winner’s name, likeness, voice, biographical information, and or statements for advertising, trade, and promotional purposes in any media now known or hereafter developed, without additional compensation or notice.

USE OF DATA AND PRIVACY: By entering, entrants agree to Sponsor’s collection and use of their personal information for the administration of the Sweepstakes and otherwise in accordance with Sponsor’s Privacy Policy.

DISPUTES AND GOVERNING LAW: By entering, entrants agree that any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action. Claims, judgments, and awards will be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees. Under no circumstances will entrants be permitted to obtain awards for punitive, incidental, or consequential damages. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of entrants and Sponsor, shall be governed by the laws of the State of California, without giving effect to any conflict of law rules. Any legal proceedings arising out of this Sweepstakes shall be instituted in the state or federal courts located in or serving Wildomar, California, and entrants consent to the jurisdiction of such courts.
